In the event of legal disputes, the place of jurisdiction is exclusively Italy.

2. PRODUCT INFORMATION
Products (every pieces of wardrobe) with corresponding article numbers, prices, pictures and technical descriptions are displayed on the website. The products offered for purchase are a not binding offer on terms that apply exclusively to the website.
The approximate delivery time is 5 weeks. The product purchased may differ from what is displayed on the website, as IDAW reserves the right to change or modify the product with regard to product improvements if necessary.

3. PRICE
All prices shown on the website are in euros. Our offers include VAT for private individuals. The prices do not include statutory VAT for BtoB transaction by legal entities. The final price of an order including any shipping costs will be communicated in the order summary before payment. In the case of an international delivery, the buyer bears any additional costs, customs duties or fees charged by any state authority in connection with the purchase. See the Delivery page for more information.

4. ORDER
The customer confirms that he has read and agreed to all information including these general terms and conditions of sale before placing the order. The order represents a purchase offer on the part of the customer towards IDAW. A contract is concluded by carrying out all steps of the check-out process and agreeing to the purchase, which is done by accepting these general sales conditions and clicking the “BUY” button, what takes place exclusively “online” via the Internet and through acceptance and processing by IDAW. We reproduce ourselves the colors of lacquered, from internationally recognize standards (RAL, NCS, Farrow & Ball).
The customer can carry out the purchase either as a “registered user” if he has registered on the website or as a “guest” if he has not previously filled in the corresponding form. Registration on IDAW.EU is free of charge and can be carried out at any time. After the customer has selected a product, checked the price, the technical characteristics and the expected delivery time, which are shown in the description, he (the customer) must click the button “CART”. This will add the selected product to the shopping cart, where content and quantity can be checked at any time and where you can either continue shopping or start check-out. The check-out can be started on the shopping cart page by clicking on the “CHECK OUT” button. All information required in the check-out process must be provided accurately and correctly. The customer can check and change all the information shown in the summary at any time and before the final approval. IDAW is not responsible for faulty deliveries that result from incorrect information in the delivery address. Any additional costs resulting from this must therefore be borne by the customer. By clicking on the “BUY” button, the customer agrees to the purchase. In order for the final order to be sent to IDAW, full payment must be made by the customer. IDAW expressly points out the cancellation policy under point 12.

5. ACCEPTED PAYMENT METHODS
The customer expresses his intention to buy on the corresponding page of the website, where, as described under point 4, he sends the order and makes the payment. The payment obligation exists from the moment of the order confirmation by clicking the button “COMPLETE ORDER”. In the event of failed payment, IDAW reserves the right to cancel the order. The customer agrees to carry out the full price of the goods ordered on the website (total price of the goods plus any shipping costs) using one of the accepted payment methods: PayPal, credit card, Klarna, IMMEDIATELY or by bank transfer. Credit card payments must be checked for validity. IDAW reserves the right to request a copy of the ID from the customer within 24 hours of purchase, which can be used to prove ownership of the credit card used. If the customer cannot provide this proof in time, IDAW reserves the right to cancel the order and refund the amount already paid. IDAW will only save personal data in compliance with data protection, Italian Law No. 196 of June 30, 2003 and subsequent changes, as specified in the “Data Protection” section of the website.
Payment details are transmitted using a server-to-server secure socket layer (SSL), one of the best security systems on the Internet. PayPal is a secure payment method that enables fast payment processing without having to provide bank details to the seller. If the customer already has a PayPal account, he can use PayPal as a payment method safely and quickly. However, he can also choose the payment method PayPal if he does not yet have a PayPal account. In this case, the customer will be redirected to a PayPal page at the time of payment, where he can enter the bank details and where he can then decide whether a PayPal account should be created or not. In the case of bank transfer, the customer has 48 hours from the order transfer to transfer the total amount to the bank account specified in the order confirmation. If the bank transfer is not completed within these 48 hours or the payment is not credited to IDAW’s bank account within 5 working days, IDAW reserves the right to cancel the order. Orders paid by bank transfer will be processed and / or shipped once payment is made and IDAW has received the full amount within the standard terms.

6. DISCOUNT
The order form shows: the total price, the discount (if any), and the reduced price for the customer.
As an advertising measure, IDAW can grant campaign discounts which customers are provided in the form of discount codes. Users who have received a discount code can activate it by entering it in the field provided in the order form. This is also possible if the user does not yet have an IDAW account. The price is then recalculated and displayed accordingly. Only a promotional discount is applicable. Promotional discounts cannot be combined with other promotions.

7. INVOICE
If the customer wants an invoice that can be used for tax purposes, he can request it by email. For this, an email must be sent to IDAW after receipt of the order confirmation.
If it is a commercial customer or on behalf of a company, all relevant information must be specified directly in the order form (company name, address, VAT number). IDAW will issue the invoice and send it to the email address specified in the order form within 15 working days of the order confirmation.

8. ORDER CONFIRMATION
The order has been placed correctly if no error messages appear during the ordering process. The customer consents to the purchase by clicking on the “BUY” button. The order will be processed as soon as IDAW receives payment of the total amount (product price plus shipping costs). IDAW will confirm the order by email (hereinafter referred to as “order confirmation”) to the email address provided by the customer. The order confirmation summarizes the selected products, corresponding prices, delivery address and order number. The customer must provide the personal data correctly, check it in the order confirmation for security and immediately report any corrections or changes to IDAW.
Higher costs that arise due to incorrect information provided by the customer or due to a delayed notification to IDAW are to be borne by the customer. The order number, which IDAW will provide on the order confirmation, must be stated with every communication with IDAW in connection with the order. It is recommended to print out the order confirmation as proof of order or to save it on a data carrier.

9. SHIPPING
The countries to which IDAW delivers and the corresponding shipping costs are specified on the website. Unless otherwise stated, the delivery is free curb. FREE DELIVERY “ON THE STREET” means that the order is unloaded at the property boundary. The driver of the truck is not obliged to carry the goods to the place of use, into the apartment or into the house. The packages must be accepted by two physically fit people. Delivery to certain rooms or floors is expressly not included. Please note: We assume that the delivery can be carried out without any problems, but we ask that you take note of the important information on delivery and contact us by email or phone if you have any questions or doubts. When ordering, we always ask for one or, if available, couple of correct telephone numbers, if possible also mobile numbers. These are required in any case so that the freight forwarder can agree with the customer before delivery or we can contact the customer with questions before delivery. It must be ensured that the street of the delivery address can be driven on with a truck of at least 12 meters length and that the truck can be stopped and unloaded. This means that there must be enough space available. General formula for this: 2.5 meter truck width plus length of the largest package (= cabinet height) plus 1 meter maneuvering width – i.e. approx. 5 – 7 meters. It must be possible to rule out the fact that everything is parked in narrow residential areas so that the truck can drive in. If necessary it is advisable to keep the parking spaces free for the intended delivery and delivery shortly before the truck arrives. It must be assured that the access to the delivery address is not impossible to drive through narrow curves and bends for a large truck and that the access is not blocked by trucks of this size or that the goods are received at one place, which is accessible for a truck. The customer accepts that the driver of the truck is responsible for the delivery or access. Therefore, the final decision about the delivery option on site is the responsibility of the driver. Transport does not include delivery to a specific floor, construction and waste disposal. In any case, the customer is responsible for ensuring that the purchased products are transported to the desired space in terms of their dimensions and can be assembled there. This also includes checking whether the ordered products can be brought through the front door, hallways and stairwells. We would be happy to inform you about the dimensions of the largest package of the upcoming delivery on request. Delivery date: The delivery week of the delivery is announced when the order is placed or when it is configured. Please note: Our furniture transporter always starts at our production facility in Italy and then goes to different delivery addresses. To organize the delivery, our furniture shipping company needs at least three consecutive days within a calendar week on which it is possible to accept the delivery. So that the delivery can be better organized by our external delivery company, we will let you know on Saturday before the delivery week when the delivery is scheduled. In addition, the customer can be contacted again a few hours before delivery in order to announce the delivery window more precisely. We cannot rule out that the arrival of the delivery is influenced by unforeseen events (in traffic, weather conditions, etc.). If the customer would like, he can also contact us to inquire about the current status before the delivery arrives. All additional costs that may arise due to delivery complications are borne by the customer. The customer ensures that at the time of delivery someone is present at the delivery address who can accept the delivery. If the transport company can not carry out the delivery because no one is present at the delivery address, the goods are brought to a warehouse of the transport company. The carrier will try to arrange a new delivery date with the customer and may charge the customer additional costs. At the time of delivery, the customer must ensure that the number of packages delivered corresponds to the number specified on the delivery note and that the packages show no external damage or deformation. The delivery note, which is signed by the customer, is proof of the delivery. Any recognizable damage to the packages or the products as well as a mismatched number of packages must be noted immediately on the delivery note. If in doubt, please make the note at the note “Acceptance and reservation” on the confirmation of receipt from the freight forwarder. If a possible damage is not noted on the delivery note, the customer has no right to object afterwards to the external features or the content of the packages. With his signature on the delivery note, the customer confirms that the delivered goods are in perfect condition.
IDAW assumes no liability for faulty delivery, delays, defective goods or damage caused by any circumstances or events that are beyond IDAW’s sphere of influence. In the event that the delivery does not arrive completely or with damaged parts at the customer, IDAW will deliver the missing or damaged goods within a reasonable period (1-4 weeks). During this period, the customer must make the delivery option feasible. The customer has no right to monetary claims. Furthermore, the customer is encouraged to immediately notify IDAW in the event of an incomplete or faulty delivery, so that a rapid subsequent or replacement delivery can take place as quickly as possible. The customer cannot request a reimbursement for incomplete or incorrectly delivered goods or any costs resulting therefrom. In addition, IDAW is not responsible for errors or defects that arise if the customer begins or continues to set up without waiting for the replacement or subsequent delivery. In case you could optionally book the delivery to the point of use, i.e. to your apartment. The place where the cabinet is brought must be at least accessible by a wide staircase. Possibly additional costs if a freight elevator, crane or similar is of course not included. Additional transport costs will be calculated for the Venice lagoon area and for the smaller islands. Additional transport costs will be calculated for the Venice lagoon area and for the smaller islands. EXTRA INFORMATION FOR DELIVERY TO SWITZERLAND. The delivery to the apartment is included in the price of the wardrobe. The place where the cabinet is brought must be at least accessible by a wide staircase. Possibly. additional costs if a freight elevator, crane or similar. The delivery to the floor and the optional installation is carried out by a company independent of IDAW, who is responsible for the service EUROMOEBEL (Letziweg 9 – 4663 Aarburg – Tel. 062 791 08 05 – Cel. 076 560 81 32 – Email euromoebel@bluewin.ch). The cost of handling the Swiss customs formalities and the Swiss VAT will be charged to the customer, who must pay them before delivery to the responsible customs office. Assembly can be carried out by the delivery company for a surcharge of 10%. The option will be suggested to the customer during the checkout phase. Deliveries may be delayed due to the Covid 19 emergency.

10. ASSEMBLY SERVICE
If you would like to book the building team, please note: Costs of the building team: The delivery on request “to the point of use” with assembly on site may be carried out by an external company, who will contact you and specify the final cost. The company can refuse delivery “to the point of use” and the assembly service without giving reasons. In this case, the customer has the right to delivery at our regular delivery conditions (delivery “on the street”), which you accept when placing the order, or to cancel the order with a refund of the order value. If necessary, delivery may be delayed somewhat for organizational reasons during assembly by the building team. The costs for the set-up will not be paid in advance when placing the order, but in cash before the set-up and on site. In addition, the amount for assembly can vary if the delivery location is difficult to reach (e.g. in historical centres etc.) or if the construction is on a high floor, which can only be reached without an elevator. Deliveries may be delayed due to the Covid 19 emergency.

11. WARRANTY
All products sold are guaranteed for 24 months (from the time of delivery) according to Italian law Decree 24/02.
In the event of a possible warranty claim, the customer should keep proof of purchase. A printout of the order confirmation is sufficient for this.
This guarantee only applies to defects that arise during normal use of the product and when used correctly. Normal signs of use or improper influences do not justify a warranty claim.
The 2-year guarantee applies to private customers. The legal guarantee of 1 year applies to business customers. IDAW products are manufactured in Italy in high quality and taking environmental protection measures into account.
In the event of a defect, IDAW will carry out a repair or an exchange without additional costs for the customer. If a reported defect is not covered by the warranty, IDAW will be charged the costs of transportation and product testing to the customer.
After consultation with the factory, IDAW will inform you of the replacement or repair period. The customer is not entitled to compensation for delays and / or the time required for the repair and return.

12. CANCELLATION POLICY
Withdrawal
According to Italian Legislative Decree 206/2005, the customer has the right to withdraw from the contract within 14 working days of receipt of the goods without giving any reason.
A right of withdrawal does not exist for products manufactured individually according to customer specifications. This includes all custom-made parts for wardrobes made to measure, fitted wardrobes, walk-in wardrobes, chests of drawers and bedside tables that have been painted in the colour of your choice (and / or whose height and, if necessary, depth have been made to measure).

Products that are not manufactured individually are, for example, shelves with regular dimensions or drawer with standard dimensions, clothes lifts etc. For these, in the event of cancellation:

To make processing easier, the notification should also be sent in advance by email to info@idaw.eu.

Consequences of cancellation
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you inform us of the cancellation of this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.
If you cancel this contract, we will send you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you choose a different type of delivery than the cheapest standard delivery we offer have) to repay immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. You bear the direct costs of returning the goods.
You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary for checking the nature, properties and functionality of the goods.
Please avoid damage and contamination. If possible, please send the goods back to us in their original packaging with all accessories and all packaging components. If necessary, use additional protective packaging. If you no longer have the original packaging, please provide suitable packaging for adequate protection against transport damage in order to avoid claims for damages due to damage due to defective packaging.
